It is published in compliance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2011 and the Digital Personal Data Protection Act, 2023, which require the publication of these Terms, along with the rules and regulations and the Privacy Policy for access or usage of the CureCredits Platform.
This electronic record is generated by a computer system and does not require any physical or digital signatures.
1. Introduction
CureCredits is operated by Nahmo Info Tech Private Limited, a company duly incorporated in India (hereinafter referred to as the "Company" or "CureCredits"). These terms of use (“Terms”) govern your use of our website www.curecredits.com (“Website”) and our CureCredits application for mobile and handheld devices (“Application”), including any subdomains thereof. Collectively, these are referred to as the “CureCredit Platform.”
By agreeing to these Terms, you also agree to our other policies, including but not limited to our Privacy Policy (“Privacy Policy”), as displayed on the Website and amended from time to time. The capitalized terms used herein shall have the meanings assigned to them in the Glossary below or as defined in the User Agreement or Merchant Agreement, as the case may be.
2. Scope & Acceptance
These Terms govern the User’s (as defined hereinbelow) engagement with the CureCredits Platform and the User’s utilization of the Services offered. The terms “you”, “your” and “yours” refer to the Users (both Permitted User and End User). The terms “we”, “us” and “our” refer to the Company and/or its affiliates.
2.1. Accessing the Platform
- The CureCredits Platform provides Services to Users through the CureCredits App and associated channels.
- The CureCredits Platform, including any products, Services, or items subscribed to (whether paid or free), is intended solely for the Users who have validly registered and agreed to these Terms.
- We may periodically provide updates or upgrades to enhance performance, fix bugs, or improve security. We recommend installing these updates; in some cases, major updates may be required for the CureCredits Platform to function properly.
3. Registration & Account Creation
3.1. Account Creation of the End User
- To utilize the Services, you will be required to register on the CureCredits Platform and share your details, including a username and password (“End User Account”).
- You must confirm that you have read and agree to abide by these Terms and the User Agreement before completing your account sign-up.
- A one-time non-refundable registration fee may be charged at the time of registration (unless waived or modified by the Company). This fee is typically valid for 1 (one) year from the date of activation. Renewal fees, if any, will be communicated prior to expiry.
- You are responsible for maintaining the confidentiality of your username and password, as well as all activities occurring under your End User Account.
- Each End User Account (tied to one mobile number and email ID) can only be used for payments to one Merchant. To pay a different Merchant, you must create a separate account with a different mobile number and email ID.
- The Company reserves the right to reject activation of any End User Account at its sole discretion, including if required details are incomplete or unsatisfactory.
- The Company shall not be liable for any misuse of information if you share your login credentials or fail to update your contact information.
3.2. Account Creation of the Permitted User
- A Permitted User will receive unique login credentials (“Permitted User Account”) upon execution of the Merchant Agreement with the Company.
- The Permitted User is responsible for maintaining the confidentiality of the username and password, as well as all activities under the Permitted User Account.
- The Permitted User will be liable for any acts or omissions by its employees, staff, or representatives using the Permitted User Account and shall indemnify the Company against any claims arising therefrom.
4. Dashboard Access for End Users
- Upon registration, the End User may be granted access to a dashboard within the CureCredits Platform.
- Through this dashboard, End Users can:
- View the Company’s Services.
- Make payments for Healthcare Services from Merchants.
- Avail other Services offered by third-party Service Providers through the CureCredits App.
- You must ensure the confidentiality of your login credentials. The Company shall not be liable for any unauthorized usage arising from your failure to secure your account.
- The Company will enable Services on the dashboard only after receiving all required documents and your acceptance of these Terms.
5. Payment Obligations of the End User
- When using any Payment Options available on the CureCredits Platform, the Company will not be responsible for any loss or damage arising from:
- Lack of authorization for any transaction.
- Exceeding preset limits set by your bank.
- Payment issues related to the transaction.
- Declined transactions.
- Non-compliance with RBI or banking regulations, including KYC requirements.
- The CureCredits Platform offers an integrated payment interface designed to be secure and user-friendly for making payments related to Healthcare Services or other Services.
- All payments must be made in Indian Rupees. No other currencies are supported.
- If a payment is withheld or not transferred to a Merchant for any reason, refunds will follow the respective payment platform’s policy and as communicated to the End User.
- Important:
- The Company acts only as a payment facilitator. It is not responsible for the non-delivery or quality of Healthcare Services provided by Merchants.
- You authorize CureCredits or its Service Providers to collect, process, and remit payments for transactions you initiate. Your relationship with the Company is on a principal-to-principal basis.
6. CureCredits Points
- CureCredits Points are virtual loyalty points you may earn on each transaction, based on terms set by Merchants and displayed on the CureCredits Platform.
- CureCredits Points can typically be redeemed for future Healthcare Services from the same or associated Merchant, if allowed by the respective Merchant.
- CureCredits Points have a fixed validity period, communicated at the time of earning. Unused points may lapse after this period, unless otherwise extended by mutual agreement between the Merchant and the Company.
- If a Merchant or the Company ceases operations or the arrangement between them terminates, the Merchant or the Company may refund any remaining CureCredits Points to the affected End Users, subject to applicable charges. The responsibility for such refunds will be determined under the Merchant Agreement.
- The Company acts only as a facilitator for CureCredits Points. All contractual obligations for Healthcare Services lie between the End User and the Merchant.
7. Fraudulent Transactions
- Users shall not engage in fraudulent or illegal activities on the CureCredits Platform. Any suspected fraud will be reported to law enforcement.
- If the Company is notified of an unauthorized transaction or potential fraud, it may suspend the related settlement or block your account pending investigation.
- The Company reserves the right to suspend, limit, or terminate a User’s access to the CureCredits Platform if:
- KYC credentials are found to be fake.
- The User violates these Terms or the Merchant/User Agreement.
- The User breaches any applicable law.
- The Company reserves the right to seek reimbursement for any excess payments made and to initiate legal proceedings if necessary.
8. User Responsibilities
8.1. Responsibilities of the End User
- You must be at least 18 years of age and capable of entering into a legally binding contract.
- You shall comply with all applicable laws and regulations while using the CureCredits Platform.
- The Company is not responsible for any liability arising out of Healthcare Services provided by Merchants.
8.2. Responsibilities of the Permitted User
- Permitted Users accept these Terms on behalf of the Merchant.
- Permitted Users shall ensure compliance with all applicable laws while providing Healthcare Services.
- The Permitted User shall indemnify the Company for any third-party claims arising from negligence or non-compliance by the Merchant.
8.3. General Responsibilities of All Users
- Users must not reproduce, distribute, or share any part of the CureCredits Platform in ways that conflict with these Terms.
- By using the CureCredits Platform, you authorize the Company to utilize your data for displaying relevant offers, advertisements, or other content.
- Users agree to comply with the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.
9. Usage Conduct
- You agree to use the CureCredits Platform only for lawful, personal, and non-commercial purposes.
- You must not:
- Use the CureCredits Platform to upload or transmit any harmful code or data.
- Attempt unauthorized access to any account or system connected to the CureCredits Platform.
- Copy, modify, adapt, or reverse-engineer any part of the CureCredits Platform.
- You acknowledge that the Company may release Upgrades that change the appearance or functionality of the CureCredits Platform.
10. COMPANY’S RIGHTS
- The Company may, at its sole discretion:
- Limit, suspend, or terminate your access to the CureCredits Platform.
- Move, delete, or refuse any content you submit.
- Define and modify usage rules and boundaries.
- Assign its rights or obligations to any third party.
- By using the CureCredits Platform, you agree to receive administrative, promotional, or other forms of communication from the Company.
11. DISCLAIMER OF WARRANTIES & LIABILITY
- “AS IS” BASIS: The CureCredits Platform, including all materials and Services, is provided “as is” and “as available” without warranties of any kind.
- The Company makes no representation or warranty:
- That the CureCredits Platform will meet your requirements.
- That errors will be corrected or that it is free from viruses.
- Regarding the reliability, completeness, or suitability of any content or Services.
- The Company is not liable for indirect, incidental, punitive, or consequential damages of any kind arising out of your use of the CureCredits Platform.
12. LINKS TO THIRD-PARTY WEBSITES & SERVICES
- The CureCredits Platform may contain links to third-party websites or services.
- The Company does not endorse or assume responsibility for such third-party websites.
- Disputes regarding third-party services should be directed to the respective provider.
13. INTELLECTUAL PROPERTY RIGHTS
- All Intellectual Property Rights related to the CureCredits Platform (software, design, text, graphics, etc.) are owned solely by the Company, its partners, or licensors.
- You agree not to reproduce, distribute, or create derivative works from any portion of the CureCredits Platform without prior written consent from the Company.
- You shall be responsible for the content you upload and must ensure you own or have rights to all such content. You agree to indemnify the Company for any claims arising from content you post that infringes third-party rights.
14. PRIVACY POLICY
- All information collected by the Company, including personal information and payment details, is subject to our Privacy Policy, available at www.curecredits.com/terms. By using the CureCredits Platform and submitting your data, you consent to our collection and usage of such data in accordance with the Privacy Policy.
15. FEEDBACK
- You agree to use good judgment when leaving feedback or reviews about other Users or the CureCredits Platform.
- If any feedback is deemed inappropriate or violates these Terms, the Company reserves the right to remove it and/or notify the relevant authorities.

16. ACCOUNT DELETION OR INACTIVATION
- Users may request account deletion by contacting support.
- Some data may be retained for legal purposes.
- Accounts of minors under 18 will be deleted upon discovery.
17. INDEMNITY
- You agree to defend, indemnify, and hold harmless the Company, its directors, shareholders, officers, employees, and representatives from and against any claims, losses, liabilities, damages, costs, or expenses (including attorney fees) arising out of or related to:
- Your use of the CureCredits Platform.
- Your violation of these Terms or any applicable laws.
- Your infringement of any third-party rights.
- Any disputes or claims arising from content you submit.
18. TERMINATION
- Termination by You: You may terminate these Terms by unsubscribing from the CureCredits Platform, subject to any obligations under the User Agreement or Merchant Agreement.
- Termination by the Company: The Company may terminate or suspend your access to the CureCredits Platform at any time if:
- You breach these Terms or other policies.
- We are required to do so by law.
- We discontinue the CureCredits Platform or your access to it for any reason.
- The Company shall not be liable for any termination-related claims or damages.
19. CONSEQUENCES OF TERMINATION
- Upon termination, all content and data associated with your account may be deleted, except where retention is required by law.
- Your license to use the CureCredits Platform will immediately end.
- The Company may pursue legal remedies if termination is due to your breach of these Terms.
- Termination does not absolve you of any outstanding financial obligations, if applicable.
20. FORCE MAJEURE
- The Company shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including internet failures, power outages, labor disputes, natural disasters, or governmental actions.
21. GOVERNING LAW & JURISDICTION
- These Terms shall be governed by and construed in accordance with the laws of India.
- The courts of [Gurugram, Haryana] (or your chosen jurisdiction) shall have exclusive jurisdiction over any disputes arising under these Terms.
22. DISPUTE RESOLUTION
- All disputes arising out of or related to the Services shall be subject to the exclusive jurisdiction of the competent courts in [Gurugram, Haryana], unless otherwise agreed in writing.
- Arbitration proceedings, if initiated, shall be conducted in accordance with the Indian Arbitration and Conciliation Act, 1996, and the award shall be final and binding on the parties.
23. AMENDMENTS & MODIFICATIONS
The Company reserves the right to modify these Terms at any time by posting updated Terms on the CureCredits Platform. It is your responsibility to review these Terms periodically. Continued use of the CureCredits Platform constitutes acceptance of any such modifications.
24. ADDITIONAL TERMS
- The Company may periodically introduce special offers, coupons, or loyalty points. These are subject to additional terms which will be specified at the time of the offer.
- Any delays or cancellations due to incorrect or misleading information provided by the User may result in additional costs borne by the User.
25. MISCELLANEOUS
- In the event of any conflict between these Terms and any other document, these Terms shall prevail.
- The Company’s failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision.
- Any notices regarding the CureCredits Platform or these Terms will be posted on the CureCredits Platform or sent by email to registered Users.
- The Company may assign or transfer its rights and obligations under these Terms to any third party without your consent.
GLOSSARY
- Application / CureCredits App: The mobile application developed by the Company to provide Services to Users.
- CureCredits Points: Virtual loyalty points earned by End Users for transactions made via the CureCredits App, redeemable for future Healthcare Services, subject to Merchant policies.
- Device: Any electronic device (computer, smartphone, tablet, etc.) used to access the CureCredits Platform.
- End User: A Customer who has successfully registered with the Company and entered into a User Agreement.
- Healthcare Services: Services offered by Merchants (hospitals, clinics, pharmacies, labs, etc.) and displayed on the CureCredits Platform.
- Merchant: Any entity (hospital, clinic, pharmacy, lab, etc.) duly registered and empaneled on the CureCredits Platform to provide Healthcare Services to End Users.
- Merchant Agreement: The agreement between a Merchant and the Company, defining their respective rights and obligations.
- Payment Options: Methods to pay for Healthcare Services, including QR code, vouchers, payment links, or other modes facilitated by CureCredits.
- Permitted User: The Merchant who has executed a Merchant Agreement with the Company, granting them a Permitted User Account.
- Services: Facilitation or assistance services, including but not limited to payment facilitation, marketing, financing, or insurance offerings through the CureCredits Platform.
- Service Providers: Third parties offering products or services (e.g., loans, insurance) integrated within the CureCredits Platform.
- Transaction: A successful payment made via the CureCredits Platform for Healthcare Services or other services.
- Upgrades: New versions or updates to the CureCredits Platform, including fixes, feature enhancements, or security patches.
- User: Any person (End User, Permitted User, or visitor) accessing or using the CureCredits Platform or Services.
- User Agreement: The agreement between the End User (Customer) and the Company at the time of registration.
